There is a purpose and a need for having an agency like child protective services. Unfortunately many parents get involved with drugs and their focus becomes destroyed and pretty soon all they can think about is satisfying themselves with these drugs. In many cases CPS should be involved and thank God they intervene, for the children's sake. Unfortunately, this agency is one of the most powerful agencies in the state. They have a lot and I mean a lot of power. When this power is used properly, then the system is fair and works properly. However and sadly there are social workers and those in the agency that decide to abuse their power. This abuse usually comes in the form of "you better do what I say or I'll take your child forever" attitude. When they abuse this power you do not get a fair shake and the laws are not followed. You must fight back and fight hard to hold that abuse in check. Even with cases without abuse, you must have good direction and good representation during this process to make sure your constitutional rights are not trampled on.
Finally, I give this advice, if someone comes to your door and they say they are from CPS, you have no legal duty to talk to them or let them in. The only time you have to let them in or let them talk to your kids is if they have the police there and the police have a search warrant. Finally, if your kids are detained by CPS, call us, you need us and you need us yesterday. Whatever you do, do not hire any old attorney.
